art: "let me ask you..could you have done better??" You know that is a negative answer question. Since I am/was not a patent license negotiator, naturally I cannot say I could have done better. However, that is not to say that other individuals with appropriate experience and background could/would not have done better (to use your words).

While you mention the "problems" of an indemnifier and the Nokia/SamSung arbitration, we really have no idea of what is going on during these negotiations and what may be holding up the signing. We don't what the sticking points are, and whether it is an intransigence or miscalculation on one or both sides.
