Ladies and Gents,

Strong bet that SOLM vs TOY will be a repeat of TIVO vs DISH.

It took forever, and DISH played hardball, but the outcome was sweet milk & honey for TIVO. It's called: "Due Process"

Don't worry about TOY going around the patent to avoid the suit. DISH tried that approach with TIVO's equipment, and it didn't stop the heat-seeking lawsuit on DISH's azz one bit. In the end, DISH ended up paying bigtime. Go read about it if you don't believe me.

DISH even argued the legitimacy of TIVO's lawsuit by fighting TIVO through the USPTO. In the end, DISH spent mega-bucks.

DISH was looking for an out, but they couldn't find one, even with the best lawyers available representing them. The bottom line is: Patents are solid. They alleviate ten times more additional litigation that would otherwise take place. SOLM has TOY dead to rights in my opinion, or else SOLM wouldn't have launched the case. It's like having a tiger by the tail.... You don't wanna let go once you grab hold.

Thank GOD for the USPTO. It truely is one of the greatest entities of out government. Notice I said: "One of"

In any event....
If TOY is smart, they'll settle faster than DISH ever did (if the evidence mounts), or they'll simply buy little SOLM out at a very good price? Only the shadow knows what will unfold, but the whole thing kinda reminds me of how Ford and Diamler bought BLDP's product rights. There was no lawsuit, but they had to have it!

The reason I think that TOY had better act faster than DISH did, is because SOLM is a U.S. company with the right product, at the right time, with the right President, U.S. Congress & Senate. Dragging this case out can only bruise TOY's image in a very green market as the Obama administration moves forward with it's policy. That's just my ten cent opinion, but I'd hate to be sitting in TOY's catbird seat if the media-driven, PRO-GREEN American jury produces a guilty verdict.

TOY is and always be a Japanese company. Japanese fight fierce, but if they're wrong about something hands down.... They will usually save face.

With all of this taken into consideration.... A lucrative position seems like a pretty good idea to me. What SOLM needs to do now is to get the word out about their product. The media is ready and waiting to jettison the awareness of this little company's product(s) to the public. It's time for SOLM to advertise and implement.
