I realize that it is common practice for defense attornies to attempt to side track the main issues of a case, especially when the main issue for their client is very weak. In this case, I don't think that the ALJ will buy into the side track regarding FRAND, basically because INFRINGEMENT is the main issue and cannot be justified because of a disagreement in rate. I have NO legal background, but it seems to me that if this case is allowed to go down the FRAND pathway, then the ITC is opening up a new can of worms that in effect changes not only its' own powers but also those of standards boards. JMO
