The big question in the next 2 months is whether the risk to both sides is great enough to forge a settlement. When both parties have something to lose, then settlement has its' greatest chance. In a convoluted way, the staff decision may be the catalyst to get the deal done, as there is now a real risk to IDCC to let the dice roll. Allowing this thing to go past the ALJ decision could be disaterous to either side and that includes Nok. A declaration of infringement is not what either Sam or Nok can afford to hear, and on the IDCC side, finding out that this endeavor was fruitless and is being tossed to the Frand court would be a devastating blow to shareholders for the intermediate term. My hope is that both sides aren't as pig headed as Jerry Yang at Yahoo, and that they realize that value isn't absolute and can be negotiated to the benefit of all parties. Gltal!
