IMO- I wouldn't be too worried about the latest appeal from Nok as I believe that it is simply a predicted action in settlement gamesmanship. Nok's only leverage is threatened appeals at every juncture, while IDCC is in possession of the ultimate hammer-letting this thing go all the way and forcing a third party to set Nok's rates. There is not one chance in hell that Nok will allow this to happen, nor will they put themselves in a position to have their products embargoed. I also can't see Nok allowing the possibility of Sam setting a frand rate ahead of them. This all leads me to believe that Nok's QCOM agreement has set the blueprint for how Nok will ultimately settle with IDCC and that involves leveraging their superior patent position versus Sam etal to get a rate that others can't match. I think we are closer than the market thinks in this regard. GLTAL!
