but to provide clearer proof that woodside was walking into this thing with their eyes wide open, i went back and read some of the depos. here's what i found. enjoy.
in plaintiffs response to woodside's MSJ on the allegations of conspiracy and aiding and abetting (filed 10/12/07), brad dowdell, woodside's land man on the midway project (see page 11) after first DENYING in his deposition that woodside had reviewed the trust documents suddenly changed his testimony after being confronted with an email that not only scheduled the review of trust documents but acknowledged woodside had sent a lawyer to review those very docs.
oops. it seems that dude committed perjury. here's something to ponder: why judges don't bitch slap liars - who are UNDER OATH - more often is beyond me because they deserve to be punished. liars make a mockery of the judicial system. just venting....
reading from page 11, dowdell's other "dishonest testimony undermines woodside's entire credibility" (1st sentence, 1st paragraph, page 15)
Consequently, the judge's order filed 7/3/08, (item (e) on the last page), specifically notated that "the motion of woodside for summary judgment for civil conspiracy is DENIED, as the court determines that there are genuine issues of material fact for trial by jury".
