But Nokia accrued $100 million dollars a year for patent liabilities. Why would they do this if they did not feel they had to eventually pay? The proof is in the pudding, we do not have a deal and it is my opinion that by Howard and company making Nokia numbers high profile did not help in negotiations.

Nokia is the 62 billion dollar Gorilla in the field.

Market Cap: 62.71B

IDCC is the 900 million dollar monkey.

Market Cap: 901.11M

This isn't about treatment it is about dollars, period. Nokia has them, IDCC needs them. No need to make grand statements about games, just deals. Maybe it would not have made a difference but it did nothing for IDCC and its shareholders for Howard and Company to proclaim victory 2 years before the battle would be fought. Kind of reminds me of George Bush on the air craft carrier declaring Mission Accomplished.
