Seems to me that Lanza is still in control. He is one the Board, and by all accounts still the majority shareholder. He ousted Lou's Board a few months back and presumably can oust the new Board when he decides.
But all of that aside, the truth of how is running the Board is easy to dtermine, if there is no new investment, then Lanza is still in control. And as of now there is no indication that there is any new investment. Moreover, the new Board has to date done a terrible job --- just what you would expect if Lanza was still in control. No, there is nothing to be happy about here, just Lanza pullin off his latest.
And of course the new Board might just all be about the court case anyway.
As I've said many time, BD is all lies all the time. Never changes. The only thing to do is work to get the SEC to shut them down.
