The Staff attorney stated that Sam would be damaged by any ban.

He then stated: If the patents are asserted against SAM then SAM will be:

1. Irreparably harmed
2. SAM will definitely prove collateral estoppel.
3. SAM will NOT satisfy some of its defenses.

These are my quickly scribbled notes from our guys. They were trying to make sense of them and it was the best they could give me on this short telephone call.

O.K. that's it. I am not certain about the Staff attorney's comments other than we now have a little more info on his thinking when he said "no violation".

The words "WCDMA component of NOK settlement" that were supposed to be confidential and not for the eyes of the public and the presence of many perceived big wigs got our guys attention quickly. They are wondering if since WCDMA is 3g and we have no 3g settlements with NOK, what could it mean other than maybe we have settled with NOK?
