Jim - here is the response I have sent to Information Week and Mr. Gardner:


Regarding “Wireless Patent Wars Heat Up” by W. David Gardner, you have accomplished the sports journalism equivalent of writing the headline in the first inning of the game. That’s just lazy – a single staff attorney with barely a years experience makes a comment about no violation of the injunction potential in the case between Samsung and IDCC and you give the case to Samsung. If you did your homework, you would know that both sides will put on their case to an Administrative Law Judge and only then will the ALJ and the ITC Commission send a final decision.

“Racked by waves of patent litigation cases” – what an outrageous comment to make while we watch foreign companies use US patented technology for years making massive profits without rewarding the intellectual property holders. At least honorable companies such as Apple and Research in Motion have signed up with IDCC to pay their dues for the technology in every one of their products. Look it up – or would that require some true journalistic investigation.
