They did sue first unless I am recalling the sequence of events incorrectly. In one of Cyberlux's claims, they want to be compensated for the money spent to investigate the sales of their shares. I highly doubt that they would or could bring a lawsuit without documentation of the trades that they are claiming occurred to manipulate the stock price. Also in the agreement is that the defendants (AJW, etc) would not own more than 4.99% of the outstanding stock which they were attempting to do and goes against security purchase agreement rules.
