For information purposes, how many individuals would normally be required in dispelling the "We believe" portion of Mr. Merritt's statement? Do you have to retain a certain credibility in order to make your patent application and/or validity "stick"?

My memory tells me that several years ago in the Motorola trial it was brought out that Motorola attempted to patent some of its tech, only to find out that IMM (IDCC) had already filed for the same.

I can't remember, but I believe this technolgy was the subject of the legal action between the two. We all know how that turned out! It would be unfortunate indeed if the system of patent review was all about big dogs and little flees LOL.
