Good morning tea leaf readers amd dot connectors.

My new thoughts are that the ITC, Batts and consolidation issues have nothing to do with the recent settlement offer from Nok which has been rejected by our estate planning expert CEO.

I believe that Nok wants to settle all issues rather than risk a finding and order of non essentiality on part or all of the patents IDCC is asking Judge Floyd to review. Nok stands to lose a ton of royalty money and its catbird position over the members of its capping cabal who cross-licensed with them 4 years ago. Those licenses are coming up for renewal and a devastation of its claimed essential patent arsenal by a UK judge will leave a mark.

The only drawback is the real possibility that the UK judge will not hear the case at all because at this point IDCC does not believe it needs a license from Nok and I have not heard Nok say IDCC must license with them either. Thus the "commercial value" reasoning for future FRAND negotiations between the parties regarding IDCC licensing the Nok portfolio is not in the cards and no real incentive is present to convince the judge to exercise his discretion. Judge Floyd is going to conduct a hearing on his decision with respect to tryying the case or not within the next 30 days. If he decides to go forward, I expect some serious negotiating from Nok to resume. The funny thing is Nok created this fire breathing, long toothed monster that is attempting to to take a bite of their ass and they are crying like babies before Judge Floyd hoping he will not let it out of the cage. C'mon judge, tell them you are going forward and walk toward that cage door. You will not have to try the case because it will be settled and dismissed.
