Ebelong: 1. I doubt seriously if the ALJ will get the expedited briefing schedule prior to the parties. 2. Sam is only on the hook if the ALJ severs the cases and sets an immediate hearing in IDCC v SAM. 3. I believe most of the attorneys here felt that NOK was grasping at straws with the request for Arbitration and felt such had been waived. The ALJ agreed but judge Batt's didn't. 4. You asked if we can sue NOK in Delaware. My recollection is that we did and the case is stayed until the ITC investigation is complete. Best guess is it will continue to be stayed until the CCA completes the appeals and we find out if we have to attend another arb with NOK. 5. Could we sue them in the UK for infringement? I guess the answer is we could, but why spend more legal fees on this issue. They will just plead for another stay to arbitrate. This arbitration is not going to go away until the CCA acts in our favor if it does.
