spencer; After reading this post I now understand your previous question about how long it takes for the ALJ to respond to a motion. Assuming there is no Appeal Court stay, and that IDCC filed their motion for a stay, I doubt that there will be any quick action by the ALJ.

A motion for a stay of an ITC investigation is an unusual occurrence. Although stays have been granted, as far as I could determine their rules do not cover that situation, and a determination is based on the circumstances of the specific case. I would say the circumstances that have led to the motion for a stay in IDCC's case are very unusual, and I am pretty sure that a lot of legal research and internal ITC discussions will be held before an order is issued.
