Badgerkid: As it stands at this moment, the ITC will go forward against both Sam and NOK. However, Judge Bats ordered Idcc to seek a stay at the ITC as to NOK. I believe this is beyond her authority and may just form part of the basis upon which the appellate court will stay her judgment.

I think most of the attorneys have stated that even if IDCC requests a stay as to NOK as ordered, the ITC will again refuse and proceed as to both SAM and NOK. All this would mean is that IDCC can not actively participate against NOK and instead its position will essentially be presented by the staff council to the extent it believes NOK infringes. In the event the appellate court refuses the stay and EVEN if the ITC ALJ reverses himself and grants the stay against NOK, IDCC can still proceed vigorously against SAM and there is nothing NOK can do about it.

All we can do now is wait and see what happens next.
