Sons: Oversimplified, the ETSI standards body is in France. NOK claims French contract law applies. As such, they say French law states that NOK has a contract with IDCC and thus they can't infringe because there is an implied license.

Regarding the rate, they say French law allows them to use the technology while rates are negotiated or litigated.

IMO this is a reach, but they have to try every trick in the book.
