Nok wants French law to apply because of the one subject per contract case. Nok managed to carve some great deals out of the old TDD venture as a strategic partner. However, they now realize that freebies for TDD really do not come into play under bundling. Who knows, Nok may have breached its obligations to promote and assist the jointly developed TDD technology within the sector and in the standards body as to render enforcement impossible.

Everyone wonders why Qcom has not come after IDCC. The answer is bundling does not increase their earnings capacity. If for some reason judges begin to rule that all patent claims for 3g are to be governed by French Law and each patent requires a separate license, then you can look forward to big fish trying to purchase our little fish because each essential patent will carry its own earning capacity via separate license.

We all know that ETSI had no intention of changing the patent licensing habit and custom in the industry, but Nok is a loose canon willing to shoot at anything that moves including its own foot from time to time.
