My question to NOK is:If you really felt that a license was implied when essentiality of patents was declared to ETSI,why did you sign a 3g license with IDCC with a rate to be determined by a trigger mechanism? Also,why did you feel that it was necessary to include a clause that prohibited IDCC from litigating for infringement for six months (after the 3g license was mutually terminated)if in fact you thought that you were not infringing because of implied consent?
