I believe they can continue to extract more bulk samples. Production simply means producing. Can mean small quantities. How stupid would it be to post that on their website...and leave it there if it was wrong? They have lawyers doing most of the legal stuff so I imagine the wording is acceptable."
What they posted on their website was: " Our initial step is to set up our processing plant and begin recovering gold as soon as possible." without a permit. The statement was not talking about sampling. It talked about MINING!.
However, you made an interesting supposition. How about this one? What if Drake has no intention of applying for a Ga. permit? In that case they could care less what Ga authorities think about their claims of mining without a permit.
The Manager of the Georgia Surface Mining Unit told me that anyone involved in mining without a permit would be subject to civil penalties.
