There is another question that should be answered. If the judge approves this continuance and rediscovery, then PXD has but one move left. Since they know all the incriminating evidence needs to be delivered to the court, which they don't want to happen, what would prevent PXD gathering up the evidence as quickly as posible submit it to the court in a sealed box and file a motion to have this evidence made inadmissable on the grounds of mosh has no legal standing and therefore dismiss the case on a summary judgement. On one end if mosh settles the standing issue PXD will have no choice to settle, on the other hand it would be worth the risk to PXD to pull one last stunt before settling, they could get lucky and win...
