With the defendants facing a ton of evidence against them, the way they fraudalently tried to shut down the trust, facing punitive damages if it goes to trial not to mention all the bad publicity against them, I wouldn't settle for less than $10 a unit. These people are just like insurance companies. They already have allocated the money to settle this suit, and it doesn't include money for extra costs such as extra damages charges court trials etc. The new trustee should have the ball to call their bluff and demand at least $10 per unit. They will gladly pay it....
