Breakthrough

The LG license fooled me, the Nok arbitration win fooled me and this win today may end up fooling me. However, I think this is the best event so far in the history of IDCC. Nok via a slip of the tongue in its press release ratified that "the sector participants" were planning to take down IDCC in the same fashion they used in 2g. Nok was the lead horse this time and just could not deliver the same knockout punch that Mot landed for 2g. They truly believed they had IDCC gutted with a sweep victory heading into the ITC hearings. This confirmation of the 3g patent did not come from an online engineering shop over the internet. It came from a judge who leans toward the negative side of patent holders generally and who certainly did IDCC no favors during the litigation. This is a very strong ruling and I am very sure that it will have the attention of many licensing departments throughout the world as 3g will continue its growth beginning in 2008. What a great word "willful" is after a very public forum has just declared your patent essential to 3g standards operations. What a great word "confidence" is after today's ruling and knowing that in a short time you are going to combat with the same foe and their fellow participant at the ITC. Do you think that this judgment might be mentioned a few times in the two ITC settlement meetings coming soon? Do you think the judge will have any hesitation at all in issuing the injunctions after IDCC proves its case? The "we really did not know" game was officially rained out today and cannot be made up at a later date before the ITC series is done.

I am going to go out on a limb and with tea leaves in my hair suggest to you that there has been an understanding or an agreement between IDCC and Nok formed in April, 2006 that a license would be entered into if Nok lost before Judge Pumphrey.
Shockingly, it just may be Nok who is our next 3g licensee.

Have a great holiday folks. I know a few friends of mine started early this morning. I am going to meet them shortly, but I do not have a chance of reaching their level. I am already prepared to answer the same questions 10 or more times, a situation that usually annoys me, but I think I will let it go in light of this great event.
