The potential for a massive settlement combined with the resumption of royalties next year is the reason people are buying and holding. Look at the volume yesterday and today compared to the volume on the two up days.

Keep in mind that as this lawsuit comes to a head, the potential settlement and resumption of royalties will begin to be priced into the stock.
