New Wave, the post you're referencing with that link simply doesn't make any sense.

You seem to be suggesting that a judge would speculate on the motives of the investors, and then throw the case out after concluding the "vast majority" of the investors (I don't know how you came up with that one) during the class period were merely day-traders and swing-traders and therefore not entitled to be heard.

Do you honestly believe even for a nanosecond that's how it works?


"Since the vast majority of the 350m or so shares traded during the class periods were done by traders moving in and out of the stock, how do these smart attorneys make a case on behalf of the traders buying and selling multiple times when it's apparent they weren't drawn into the stock for long term purposes based on Wave's (clearly worded) PRs on Intel and IBM?

How many judges would even want to fool with this one, even if they've got nothing better to do?"
