Loop: Nice presentation on the art of expert witness depositions. Seriously doubt that daubert challenges would be effective against the experts in these cases but you never know. Our board members must accept that the risk of dress rehearsals is real and significant. I have been in trials wherein the deposition or trial testimony of a witness is being sent around the world for examination and tweaking by lawyers and experts as it happens. Each recess is an opportunity for the lawyers and experts to change the nuance of each spoken or written word. Money and technology allows almost instant access to microscopic examination of each word of testimony and the opportunity to change on the fly. There is no end to the art of ambush.
