In my opinion, there's a solid case for showing that Mr. Rivera misled shareholders as well. Those press releases are designed to communicate information beyond the semantics. If asked for the basis for making his statements for all those deals which he "anticipated" would happen, I'm guessing he would be very light on articulating any material basis.

Most of Mr. Rivera's press releases are "technically correct" but appear wordsmithed to suggest much more than reality or leave out important information to suggest the probability of something much bigger. For one example, why compare the volume of liquid produced by pyrolysis to the volume of biodiesel produced by extraction and transesterification unless there was already some solid basis for believing the two liquids are functionally similar?--the only other reason for such an apples-to-oranges comparison would be to mislead shareholders.

Per Mr. Rivera's statements, most shareholders do believe he has a biodiesel-equivalent. After all, in addition to the volume comparison, he also says it doesn't have any of the drawbacks associated with biodiesel. A normal person will assume it also works like biodiesel. Similarily, if a person said he produced a superior, heavy duty, efficient, revolutionary vehicle which didn't have any of the drawbacks associated with other vehicles such as heavy trucks, you might assume this vehicle, in addition to having no drawbacks such as pollution or significant maintenance, would probably also be useful for hauling heavy loads, otherwise why make such a comparison? However, a unicycle would certainly fit the "no associated drawbacks" but would be virtually useless for doing the work a truck is designed to do. There's a reason why Mr. Rivera doesn't show any objective evidence of value and I believe it's because he can't produce any such evidence. He wordsmiths to get shareholders to part with their money.
