Yes, read the last part of my answer (I just added it to address your inquiry).

"If a default judgment is entered, Rizvi need merely go to court and have such default judgement removed on the basis that there has been a recent change of control of CBAY from Pawson to Rizvi. Probably at that point the suit against CBAY gets thrown out and proceeds only against Pawson, wherever he may be, personally, i.e., the default judgment against Pawson stands and CBAY is dismissed from the suit."

I say this because a suit that is against the Company almost never names the President of that Company personally. Conversely, a suit that is against the individual almost always names the Company that that person controls. The fact that the suit names both Pawson and CBAY leads me to believe that the suit is against Pawson personally and CBAY was just thrown in to collect any potential judgment.
