Since there seems to be no limit to the number of times this dead horse can be kicked, a few additional scenarios are worth considering. For example, a tiered fee that, while preset and not on a per unit basis, has step-ups built in that increases the fee upon each of the following; a) the roll-out occurs in Europe, b) the roll-out occurs in Asia, c) the 3G version comes to market (remember .38/phone is NOT THAT unreasonable for the 2G phone) d) if Apple elects the Infineon chip in the 3G phone,as an in lieu fee for the IDCC stack, e) sales hit a certain milestone, or, f) any of the above - or something completely different. Point is, as has been said, nobody but a few at Apple and IDCC know for sure. And the estimates of .38/phone, while appropriate for 2G, CANNOT apply for 3G or you've just tossed the FRAND agreements right out the window.
