bulldzr, great post and big reminder to all that this arbitration is for 2g and 2.5g only. We will surely be disappointed if we think there is even a remote possibility that the arbitration panel could somehow wrap 3g into any decision. The only way 3g becomes part of this dispute is if, and only if, there is a settlement between the parties BEFORE the arbitration panel rules. If this goes all the way then it concerns exactly what management has stated, 2g & 2.5g tdma & GSM only.

I do believe the final resolution of this 2g dispute will be the watershed event that will drive many, many more license agreements for both 2g & 3g infringers. I firmly believe most, if not all, of the big manufacturers are waiting on the sidelines to see what happens with the Nokia dispute before signing any agreement.

IDCC, I believe, will not sign any 3g agreement with the major players unless 2g is resolved and part of this thinking is because by signing just a 3g only agreement is almost giving away 2g which would cause the MFL provision to kick in and result in a give away for all current licensees.

My hope is that once Nokia pays for 2g, then Ericy will sign for 3g which will be the trigger again for Nokia. I believe Ericy will wait to see if Nokia pays for 2g and if they don't they will want some type of concession from IDCC for paid up 2g royalties. I just hope if this plays out like this that Nokia will not then take the arb route again. This is getting ahead of things and let's just get the first step taken care of soon.
