Well the court has yet to decide the issue but it is easilly believable as the company has been attempting to suvive on a shoestring. I have never been in the trap that current management is in. The SEC is literally in control of their survival. If they can file their financials they can the sell stock to fund their future. If the SEC is not satisfied with the refilings they will likely run out of time. It still remains to be seen how the end game plays out.
