If they settle on the basis of fraud charges, the insurance company may say, no, we won't pay unless you go to trial so you are on your own in your settlement. Furthermore, if you are guilty of fraud after it does go to trial, we won't pay either.
What is your point, anyway?
If it is that it is difficult to prove fraud, I agree. That does not affect what I said about insurance coverage.
