"BCIT has a snowballs chance of getting a judge to find us guilty in this" - BCIT doesn't want to find us guilty IMO. They want the judge to throw out the case and say "sorry, I'm convinced these shareholders have real shares or at least entitled to real shares." What would brokers do with that? We would be legally empowered to challenge them if they resisted. This what I'm hoping for anyway.
