Yes, but those that receive dismissal in that manner will not have proven their innocence of how they purchased the shares, nor will they be officially deemed legitimate shareholders by the court.

I'd much rather prove my innocence, have the court consider me a legit shareholder with no intention of malice, and then go back to my broker and shove that ruling in their face.
