IN CHAMBERS: Bill Frizzell, Esq., Texas counsel, also present on behalf of
Pltf.
Upon Court's inquiry as to notice, Mr. Koch stated he did not give
notice as the relief Pltf is seeking is not to take money out of certain
accounts or sell certain property and expressed concern that if notice was
given, Defts will take money out of the accounts, and referred to the second
page of the Application. Upon Court's inquiry as to what harm may fall to
Defts if the Court should issue a TRO, Mr. Koch stated he does not think the
house is up for sale and does not know the amount in the brokerage account.
Mr. Frizzell stated he will be filing a pro hac vice application, and made
statements as to the corporation. Counsel concurred the Preliminary
Injunction hearing would take one-half day to a full day. Following
colloquy regarding a bond, COURT ORDERED, Pltf's Application for Temporary
Restraining Order (TRO) GRANTED; Bond set at $10,000.00; matter set for
HEARING. Court stated for the record that the reason that the application
was not noticed to Defts is because Pltf's counsel can indicates that giving
notice would likely cause irreparable harm because the protection Pltf is
seeking would likely be thwarted. Order signed in Open Court.
