Important Case updates from Pacer:
In the matter of the Criminal Case 2:07-mj-00304:

Two new matters have been filed:
04/02/2007 4 Rule 5(c)(3) Documents Received FROM THE DISTRICT OF UTAH (07-M-105) as to JAMES PLANT. (jcz, ) (Entered: 04/02/2007)
04/03/2007 5 MOTION for Extension of Time to Indict AND EXCLUSION OF TIME UNDER THE SPEEDY TRIAL ACT by USA as to JAMES PLANT. (TSAO, LEO) (Entered: 04/03/2007)

The reason given in document #5:

On March 13, 2007, defendant James Plant was arrested in St. George,
Utah on a complaint and warrant charging him with violations of securities fraud, in violation of
15 U.S.C. §§ 78j(b), 78ff, 17 C.F.R. § 240.10b-5, and aiding and abetting securities fraud, in
violation of 18 U.S.C. § 2. The warrant was authorized by United States Magistrate Judge Jacob
P. Hart.
2. On the same day, the defendant appeared in St. George Utah before United
States Magistrate Judge Robert Braithwaite. The defendant and government agreed to the
defendant’s release on his own recognizance pending the defendant’s appearance in Philadelphia.
The defendant is scheduled to appear in Philadelphia before Judge Jacob P. Hart on April 6,
2007.
3. To allow the parties the opportunity to explore a non-trial disposition, the
government requests a sixty day extension of the time under 18 U.S.C. § 3161(b) within which
an indictment or information must be filed by the government.
4. The government has spoken to defendant’s counsel, Gary Krupkin,
Esquire, and he consents to this request for extension of time.
WHEREFORE, to prevent a miscarriage of justice, the government requests that
the Court grant this motion and enter the attached order for an extension and exclusion of time
under the Speedy Trial Act.

No new information.


So, plant has a hearing tomorrow. I will keep an eye out for further developments afterward.

According to the reporting of a "duped" company: As of 1/22/07, the Company had 200M (Float) & 700M (OS) Shares. However, according to TD, on 3/16, 382M shares were traded; on 3/20, 302M were moved; between 3/15-3/22, 898M total. I wonder who to believe.
