rhlytle first there is a finding of the presented by the Plaintif is filed under the proper law governing the action requested or a similar finding of governing law. The will yield a summary judgement against the suit without prejudice, meaning they can refile the suit based upon the direction of the court for a rehearing. Then there is the finding that the Plaintif does not offer sufficient evidence, acceptable to the Court, that justifies their claim. This will yield a Summary judgement against the suit with prejudice, which means the Plaintifs can appeal the decision, but essentially the case is over. Finally the Court can decide that there is sufficient evidence to support the Plaintifs claim and the suit will be allowed to be heard in court. There is no discussion of the possibility fo the suit being successful in any of the decisions.
