Court Update.
The Oral Arguments for Motion to Dismiss this Thursday has been canceled.
Both Globetel and the Plaintiff's attorney's filed reasons why the case should be dismissed and why the case should not be dismissed. The Judge ruled Friday March 16th that there was enough information that was presented in the written documents supplied by both parties to make her Decisions. Therefore she cancelled the Oral argument for this Week. Here is a paragraph form that Order. From the Pacer Website. (My bold and underline)
"ORDERED AND ADJUDGED that the Defendants’ Motion to Reschedule Hearing Date is GRANTED in part and DENIED in part. The oral argument presently scheduled for March 22, 2007 is cancelled. No other hearing date will be set,as having carefully reviewed the parties’ memoranda and the applicable law, the undersigned no longer sees a need for oral argument. DONE AND ORDERED in Chambers at Miami, Florida this 16th day of March, 2007.
I just spoke to the Alexis Shapiro. She said that it appears the Judge has made a decision. Alexis feels confident in the written argument they presented to the Judge and feels the Plaintiffs argument is Ridicules. She mentioned that it's a good sign when the Judge does not need to hear there arguments based on what was filed in the written documents. The Judges decision could be today or unfortunately in 2 months.
