In reality it is because you have run out of excuses for Tilton. Bottom line he is still 100% active in managing the company. Otherwise, someone else would have represented the company in the hearing because the hearing is not against Tilton, it is against NSAV. he is the figurehead of NSAV and if he wants something done he has full authority to execute it and no one can say no to him.
