If you're talking about yesterday's ruling, it does not give Amarin the "chance to get the U.S. market back." That ship sailed when the Supreme Court declined to hear the final appeal of Judge Du's March 2020 ruling. At most, the ruling gives Amarin the chance to get some damages or a settlement from Hikma down the road. And only Hikma, since it is the only generic that was sued. Since the other generics came along later, I'm sure they didn't make the same mistakes Hikma made. Plus, I'm sure they saw that the insurance companies, pharmacies, doctors and U.S. states who require generics be dispensed when available ensured that they would get to violate Amarin's valid patents without them even needing to cheat. I guess the only chance the other generic companies could be drawn in would be if emails and other evidence discovered from Hikma's files showed the company colluding with other generics against Amarin. But I highly doubt they'd be so stupid.
