Thanks brew your right however if there is a lawsuit and you get pennys on the dollar you can deduct the rest of the entire loss off capital gains on the year of the final decision .Example if you lost 100k and they gave you10 you can deduct 90k off your total CG for that year.This is why it is important to pursue the LAWSUIT!!!!!!!!
