Scams come in many forms. Fake it till you make it and extend and pretend is a scam. Elizabeth Holmes is locked up for the same type of scam.

When you knowingly mislead investors for over two decades about commercialization and meaningful revenue, they are scamming those investors for their own personal benefit of a paycheck and various other perks that come along with being a director of a public company.

When you take a bonus of a full quarters worth of investors cash knowing commercialization won’t be for another 5 to 10 years that is a scam.

They know and knew exactly what they are/were doing. JM’s comment to KCCO just proves it even more.
