Q's legal analysis of the XERI/XTI situation is based on a total misunderstanding of contract law. A contract that has effectively expired (ie, the JV agreement) was clearly superseded by a subsequent contract (ie, Exhibit D / the Letter Agreement) -- and XTI hasn't tried to demand mediation or arbitration -- probably because they are afraid of losing there as well as losing in court.
