The Non-Opioids Prevent Addiction in the Nation (NOPAIN) Act, signed into law in December 2022, helps patients and providers access FDA-approved non-opioid pain management treatments in outpatient surgical settings. The law establishes separate payments for non-opioid treatments, such as hospital outpatient department services and ambulatory surgical center services, under the Medicare prospective payment system. The law also gives patients more control over their healthcare.

The NOPAIN Act expands patient and provider access to non-opioids starting in 2025. Before the law was signed, hospitals received the same payment from Medicare regardless of whether a physician prescribed an opioid or a non-opioid.
The law applies to treatments that have been shown to replace or reduce opioid consumption through clinical trials or data. For example, one analysis indicates that individuals who received opioids following surgery experienced less post-op pain and did not consume as many opioids during recovery.
