The 40 days is for the very first LOI any extension from then is at the choice of the two company's... and the 40 days is only if they continue on with the LOI after the initial announcement ...if its canceled then they can tell you that when ever they want. That may be on me as I did state it was 40 days, but may not have explained it in its entirety
