The big difference is this. Adelstein's money was a recovery of what he actually lent to Walther, plus the fees, actual expenses and interest awarded by the court. Adelstein recovered his own money. Walther profited off using and misappropriating other people's money. Walther awarded himself shareholders money. The courts weren't involved. No one else consented to his grifting. It was a singular theft.
