We are approaching the stage where settlement seems probable after MTD denial.

Strongly disagree.

The Finacial TImes article notes:

If Citadel Securities and its ilk are to beat this case and prevent a string of copycat suits, they will probably have to give the rest of us more of a peek ...

The FT writer is saying there will be copy cats if they do not win in Court. So a settlement here would just mean a wave of lawsuits as almost any company can show this type pattern (canceled sell orders with the MM also buying at about the same time) whenever there is a market sell off.
