The facts are that the Holcomb's are subject of a court matter for eviction, they have signed a loan note, they are delinquent, and the Counterclaim is not of any consequence; the fact they have partly performed under the loan note brings it into fact. The counterclaim, much like the failed B&K one, is just another tactic to waste the courts time.

The Plaintiff owns the building not Holcomb and the Holcomb is indebted to the Plaintiff under the loan agreement.
