After Danzik’s company, RDX, happened to come into possession of six million dollars in tax credit funds that actually belonged to another company, Danzik decided to keep the money for himself. (In the Justice’s words, “Danzik stole all of the money.”)
Danzik violated and failed to comply with two different orders by Justice Kornreich: an Attachment Order which required him to put the tax credit funds in a separate account to be controlled by the court, and a Temporary Restraining Order which prohibited RDX from transferring or spending its assets, except for the payment of salaries, etc.
Instead, Danzik set up a shell company (M2R) to obscure and conceal his financial dealings. As the Justice wrote, “M2R is a sham company that exists solely for the purpose of evading this court’s orders and defrauding RDX’s creditors.”
Danzik pressured the witness David Bogardus, a former RDX employee, to sign a false affidavit, which falsely asserted that Danzik had nothing to do with M2R.
Danzik also coerced his employee Ms. Blazar into submitting false affidavits.
In the middle of the May 2016 contempt hearing resulting from his violation of Justice Kornreich’s orders, Danzik caused a stay of the proceedings by fraudulently filing for bankruptcy, almost certainly committing perjury in the process. As the Justice wrote: “It appears that the RDX Parties filed for bankruptcy to avoid the contempt hearing and sought to have this action adjudicated by another court. The bankruptcy court judges did not countenance this ploy.”
Danzik has engaged in the dishonest practices of “backdating invoices; taking money from the company under the pretense of fake business expenses; and lying about not receiving compensation from the company when, in fact, his salary was being withheld and used to set off his debt to the company…”
