The truth IS an absolute defense to defamation if it’s actually the truth. The Guppy flat out said Sharp committed perjury and is under investigation by a grand jury in Nevada. I think that will turn out to have been a false statement. So no protection.



Whether he committed perjury or not requires more evidence than we currently have. If Sharp doesn't come up with a merger soon, then I doubt a judge would consider the accusation defamatory. Heck, I think Sharp perjured himself repeatedly already, based on similar statements with GVSI and WNFT, but I don't think they will go after him for any of it.

The bigger question is whether her accusations of indictment or a grand jury are false statements or not. As best as I could tell, she never claimed she has absolute proof about anything, she has just repeatedly said that he will be indicted and that grand juries are secret so we won't know until it happens. That seems opinion to me, but she should be more careful about it being opinion, not fact.


Since I truly don't care either way, I'm just eating my popcorn and watching the world burn. I checked the Sharp v. Rosen defamation and it looks like there is actually a hearing on 1/19. I wonder if that is public like in Nevada, we could have a viewing party!
